Biohazard Cleanup Company

1. Definitions
- 
“Company”, “We”, or “Us” refers to Biohazard Cleanup Company.
 - 
“Client”, “You”, or “Your” means the person, business, or organisation requesting our services.
 - 
“Technician” means our certified biohazard cleaning staff or subcontractors.
 - 
“Services” means all biohazard-related cleaning, decontamination, waste clearance, and any related work provided by the Company.
 - 
“Hazardous Waste” includes but is not limited to blood, bodily fluids, urine, faeces, sharps, PPE, and other contaminated materials.
 
2. Availability & Service Area
- 
We operate 24 hours a day, 7 days a week, across England, Scotland, Wales, and Ireland, including all cities, towns, and rural areas.
 - 
Response time is typically within 30 minutes, subject to location, emergency level, and traffic conditions.
 - 
Services to Crown Dependencies (e.g., Isle of Man, Jersey, Guernsey) and British Overseas Territories (e.g., Gibraltar, BVI) may be available by arrangement.
 
3. Booking and Acceptance of Terms
- 
By making a booking (via phone, website, email, WhatsApp, or in-person), you agree to these Terms and Conditions.
 - 
Bookings are only confirmed once:
- 
A formal quote has been accepted.
 - 
A time and date are agreed.
 - 
A deposit (if applicable) has been paid.
 
 - 
 
4. Service Charges and Payment
- 
Prices will be quoted individually based on the scope of work, severity, and location.
 - 
VAT is charged where applicable.
 - 
Payment is due immediately upon completion of services unless otherwise agreed in writing.
 - 
We accept bank transfer, debit/credit card, or approved invoicing for business accounts.
 - 
Delayed or non-payment may result in legal action and the application of interest at 8% per annum above the Bank of England base rate.
 
5. Cancellation & Rescheduling
- 
You may cancel or reschedule a booking at no charge up to 24 hours before the scheduled time.
 - 
Cancellations made less than 24 hours before the appointment may incur a cancellation fee of up to 50% of the quoted amount, especially in emergency callouts or long-distance jobs.
 - 
Emergency callouts (attended within 30–90 minutes) are non-refundable once our technician is en route.
 
6. Health & Safety Compliance
- 
All work is carried out in strict accordance with:
- 
Control of Substances Hazardous to Health (COSHH) Regulations
 - 
Environmental Protection Act 1990
 - 
Health and Safety at Work Act 1974
 - 
Waste Management Licensing Regulations (UK and Ireland)
 
 - 
 - 
Technicians are equipped with appropriate PPE, biohazard suits, respirators, and decontamination materials.
 - 
The Client agrees to provide safe access to the site and notify us of any known hazards, including gas leaks, structural damage, pests, or unsecured firearms.
 
7. Waste Disposal & Documentation
- 
We are licensed to remove and transport hazardous and biohazardous waste.
 - 
All waste is transported to licensed facilities in compliance with:
- 
Environment Agency (England)
 - 
SEPA (Scotland)
 - 
Natural Resources Wales
 - 
NIEA (Northern Ireland)
 - 
EPA (Republic of Ireland)
 
 - 
 - 
The Client will receive Waste Transfer Notes (WTNs) or Hazardous Waste Consignment Notes as applicable.
 - 
Copies are retained by the Company for a minimum of 2 years.
 
8. Limitation of Liability
- 
The Company will not be liable for:
- 
Pre-existing structural damage
 - 
Unavoidable damage caused during decontamination or removal
 - 
Loss of items that are unsalvageable due to contamination
 
 - 
 - 
Total liability is limited to the total fee paid for services rendered.
 - 
We will not be held liable for consequential losses, business interruption, or emotional distress caused by the incident being cleaned.
 
9. Right to Refuse Service
We reserve the right to refuse service or stop work at any time if:
- 
There is a risk to the safety of our technicians
 - 
Illegal activity is discovered or suspected
 - 
Aggressive, abusive, or inappropriate behaviour is exhibited
 
10. Insurance & Certification
- 
We carry full Public Liability Insurance, Employers’ Liability Insurance, and Professional Indemnity Cover.
 - 
All technicians are trained in biohazard cleaning, sharps handling, PPE use, infection control, and waste regulations.
 
11. Confidentiality & Privacy
- 
We operate with full discretion and do not share Client details or site information unless required by law.
 - 
Client data is stored securely and handled in accordance with the UK GDPR and Data Protection Act 2018.
 
12. Complaints Procedure
- 
We aim for 100% satisfaction. If you’re not happy with our service:
- 
Please contact us within 24 hours of service completion
 - 
We will respond to all complaints within 5 working days
 - 
If unresolved, you may escalate the matter to Trading Standards or the Environment Agency (for regulatory breaches)
 
 - 
 
13. Force Majeure
We are not liable for delays or failures to perform services due to events beyond our reasonable control, including:
- 
Extreme weather
 - 
Road closures
 - 
Acts of terrorism
 - 
Natural disasters
 - 
Government restrictions
 
14. Governing Law
These Terms and Conditions are governed by the laws of:
- 
England and Wales
 - 
Scotland
 - 
Northern Ireland
 - 
Republic of Ireland
 
Any disputes will be subject to the jurisdiction of the relevant court in the country where the service was provided.
15. Amendments
We reserve the right to update or amend these Terms and Conditions at any time. The latest version will always be available on our website.
